Appeal of Zoning By-law Amendment OLT-24-000956

This information update relates to the appeal of the Municipality’s decision to deny a zoning by-law amendment for 22226 Adelaide Road to the Ontario Land Tribunal.

Background
The application seeks to amend the zoning for the subject property from Future Development to a site specific Highway Commercial (C2-#) to permit a drive-thru restaurant.

Planning Staff prepared a report August 6, 2024 that identified concerns with the application relating to storm water management, sanitary servicing, road widening, sufficiency of parking and sufficiency of the landscape buffer strip. Staff also requested additional information from the applicant.

Members of the public expressed a range of concerns, including—but not limited to—noise, odour, whether the application meets the character of the area, and the demand for the proposed use.

Council refused the application and the applicant appealed that decision to the Ontario Land Tribunal on September 5, 2024.

A 5-day hearing was scheduled to begin June 9, 2025.

Settlement Hearing
After the appeal was filed the Applicant provided the additional information that staff requested and made changes to the application to address staff concerns including:

The owner has modified the site plan as follows:
1) Increased the car stacking in the drive through queue from 5 to 8 cars.
2) The road right-of-way conveyance has been increased from 1.31 m to 2.62 m.
3) The landscaping adjacent to the residentially zoned parcel has increased from 1.3 m to 2.0 m.
4) A loading space for deliveries has now been added to the site plan.
It is noteworthy that the following site plan features have not changed:
1) The size of the building (411 m2), 2) The number of parking spaces (26), 3) Drive through, and 4) Access points to/from Adelaide Road and Allen Road.

A site plan application has not been submitted to the municipality as of yet however an application will need to address the details of the proposal such as noise and odour.


As all staff concerns have now been addressed, Council has agreed to a settlement that will be presented to the Ontario Land Tribunal on June 9, 2025 for a decision.
